Chapter 7 Process

The Chapter 7 process is somewhat straightforward, but it requires a knowledge of the information that needs to be presented so that you can move through it as quickly and efficiently as possible.

The process begins after the filer submits information regarding his or her property, creditors, income, executory contracts and tax return, among other information. Additionally, it is necessary to detail any property that is exempted. Failure to do so can result in property loss.

Once one files, he or she will have the protection of the automatic stay, preventing creditor harassment and any other debt collection attempts, including wage garnishment.

Following this, the assigned bankruptcy trustee will meet with creditors and question you about debts and assets. In certain cases, all assets are exempted or none are considered at all.

Following this, all debts are discharged.
