Spousal Support or Alimony

When two people divorce, the income and financial resources that are used to support one household must now support two. In some circumstances, courts may award spousal support to help a lower-earning spouse maintain his or her accustomed lifestyle and obtain the education and training necessary to become self-sufficient.

At The Law Offices of Shelly L. Kennedy, we help men and women get fair spousal support orders that allow them to leave their marriages in the most financially secure manner possible. Our offices are conveniently located in Port Clinton and Sandusky.

WE WILL FIGHT FOR YOUR FINANCIAL HEALTH

Spousal support, commonly called alimony, can be awarded to either spouse. In Ohio, courts generally see spousal support as a rehabilitative tool used to help the lower-earning spouse get back on his or her feet and become financially independent after divorce. However, many factors determine the amount and duration of support payments. Common considerations include:

  • The length of the marriage
  • The age and health of the spouses
  • The income of both spouses
  • The education, training and work history of each spouse
  • Whether one spouse gave up a career to raise children

When spousal support is ordered, it can take several different forms, including period payments, a lump sum payment, real estate or personal property.

MODIFYING SPOUSAL SUPPORT ORDERS

In certain circumstances, spousal support orders may be modified by a judge. Common reasons to modify alimony orders include:

  • Changed economic circumstances, such as an increase in the recipient's income or a decrease in the payor's income
  • Death or remarriage of the recipient spouse
  • Certain cohabitation situations
  • Retirement of the payor spouse
